This regulation applies to all providers and users of Artificial Intelligence systems in the EU, and even to entities outside the EU that place systems in the EU market or utilize their results within the bloc. The regulation classifies Artificial Intelligence uses into risk categories—minimal, limited, high, and unacceptable—mandating stricter controls for higher-risk applications, such as recruitment. From February 2025, companies must eradicate ´unacceptable´ Artificial Intelligence and ensure all employees are trained in compliant usage. By contrast, the United States lacks a federal regulatory framework; following deregulatory executive guidance issued in early 2025, federal agencies rescinded existing guidance, shifting regulatory momentum to state and local governments. Significant state-level efforts, like Virginia´s proposed High-Risk Artificial Intelligence Developer and Deployer Act, have faced setbacks, but employer obligations around Anti-discrimination and privacy persist through longstanding federal and local statutes.

The use of Artificial Intelligence in recruitment exposes companies to wider legal risks, especially around bias, data security, and privacy. Algorithms may perpetuate or even amplify existing biases, leading to inadvertent discrimination based on protected characteristics—strictly prohibited under EU Directive 2000/78/EC and numerous U.S. statutes. Handling candidate data also invokes data protection requirements, notably the EU General Data Protection Regulation (GDPR), and over 20 U.S. state laws that regulate employer data practices. Breaches in discrimination, security, or privacy can result in substantial penalties: under GDPR, fines can reach EUR 20 million or 4% of annual global turnover, while the EU Artificial Intelligence Regulation allows for penalties up to EUR 35 million or 7% of worldwide turnover. Damages for individual claims and punitive awards vary by jurisdiction, but can be severe—especially in countries permitting punitive damages, like the UK—and extend to administrative fines from European and national data authorities.

To reduce legal exposure, employers in the EU should remove banned Artificial Intelligence, deliver robust employee training, and anticipate additional regulatory requirements by August 2026. U.S. employers should inform candidates of Artificial Intelligence use in hiring, secure their written consent, provide manual alternatives, implement bias mitigation and independent audits, and retain meaningful human oversight. Proactive adherence to regional regulations, data privacy laws, and anti-discrimination statutes is critical for maintaining ethical hiring practices and safeguarding against significant financial penalties and reputational harm.
